Social contract theory offers a powerful method and metaphor for the study of organizational ethics. This paper considers the variant of the social contract that has arguably gained the most attention among business ethicists: integrative social contracts theory or ISCT [Donaldson and Dunfee: 1999, Ties That Bind (Harvard Business School Press, Boston)]. A core precept of ISCT – that consent to membership in an organization entails obligations to follow the norms of that organization, subject to the moral minimums of basic (...) human rights – is a reasonable and appealing notion. One potential challenge for those attempting to apply this idea, however, lies in the dynamic nature of social norms. Organizational norms evolve, often through the conscious efforts of community members and leaders. As currently formulated, ISCT offers a framework that under-appreciates the evolving nature of moral norms. In this paper, we extend ISCT by considering the circumstances under which the terms of and parties to social contracts change. Michael Polanyi criticized the neo‐Darwinian synthesis on two grounds: that accidental hereditary changes bringing adaptive advantages cannot account for the rise of discontinuous new species, and that a Ideological ordering principle is needed to explain evolutionary advance. I commend the previous articles by John Apczynski and Richard Gelwick and also argue, more strongly than they, that Polanyi's critique of evolutionary theory is flawed. It relies on an inappropriate notion of progress and untenable analogies from the human process of scientific discovery (...) and the fact that in physical systems minimal potential energy is most stable. Yet within a life of commitment to transcendent values humans can directly experience purpose and meaning, and in developing this notion Polanyi makes his greatest contribution to teleology. Forensic psychologists face a variety of ethical issues in conducting evaluations. One such issue is attorney presence during a forensic evaluation. In forensic evaluations, it is necessary to use standardized procedures while also attending to the rights of the individuals being assessed. This article examines the neuropsychological literature on extraneous influences in evaluations including effects of attorney presence. Then the article discusses the limited knowledge about attorney presence during forensic evaluations, addresses attorney motivations for being present during an evaluation, and (...) considers attorney presence in the context of ethical mandates. Finally, suggestions are offered for forensic clinicians confronted with attorneys who wish to be present during assessments. (shrink)

The American Psychological Association's (APA's) as well as other professional organizations' (e.g., American Psychiatric Association) removal of homosexuality as a mental disorder represented a paradigmatic shift in thinking about exual orientation. Since then, APA (2000) disseminated guidelines for working with lesbian, gay, and bisexual (LGB) clients, and a variety of scholars and researchers alike have advocated affirmative therapeutic interventions with LGB individuals. Despite these efforts, the controversy over treating individuals with LGB orientations using nonaffirmative techniques continues. In this discussion, the (...) limited evidence regarding the efficacy and effects of conversion therapy is surveyed, particularly in the context of empirically supported treatment criteria summarized by Division 12 (clinical psychology) of the APA. Authors then consider the resulting ethical considerations in performing conversion therapy and propose alternative uses of affirmative therapy on the basis of ethical standards defined by APA. Finally, options for treating LGB individuals who are coming to terms with their sexual orientations are discussed. (shrink)

Will stakeholder theory continue to transform how we think about business and society? On the occasion of this journal’s 60th anniversary, this review article examines the journal’s role in shaping stakeholder theory to date and suggests that it still has transformative potential. We conducted a bibliometric analysis of co-citations in the literature from 1984 to 2020. Reporting these results, we examine the field’s evolving structure. Contextualized theoretically as an accomplishment of institutional work—the creation of a meaningful and innovative field ideology—this (...) structure is remarkable for how it integrates ethical and behavioral arguments, invites engagement from adjacent domains, and arrives at important insights for business and society. Cramer et al. articulate a novel perspective on comorbidity. However, their network models must be compared with more parsimonious latent variable models before conclusions can be drawn about network models as plausible accounts of comorbidity. Latent variable models have proven generative in studying psychopathology and its external correlates, and we doubt network models will prove as useful for psychopathology research.

Drawing on Deleuze’s ‘Postscript on Control Societies’, our initial focus in this article will be on the role of institutions within societies of control, an analysis which brings Deleuze into the orbit of Ervin Goffman’s famous ethnographic work on total institutions. This cross-comparative analysis of Deleuze and Goffman will allow us to show how institutions of control function by sequencing ‘dividuals’ across institutional domains in a continual process of totalization. Inspired by James Williams’s recent work on the ‘process philosophy (...) of signs’, we then argue that a critique of totalizing institutions can be positively articulated as a process-oriented challenge to algorithmic technologies and as a counter-sequencing of institutional control. We conclude with some reflections on the emergent modes of resistance that challenge both institutional and technological control, and we will proffer criteria for assessing such practices in relation to the two-sided nature of critique they enact, both processual and counter-sequential. Da gegenwärtig kein allgemeinverbindlicher Begriff des ‚Neukantianismus‘ oder gar der ‚Transzendentalphilosophie‘ zur Verfügung steht und somit unter heutigen Bedingungen nicht aufs Geratewohl eine Geschichte der transzendentalsystematischen Bemühungen des 20. Jahrhunderts verfaßt werden kann, lag es nahe, sich diesem Thema anhand einer Analyse der Diskussionen zu nähern, in denen sich die sogenannte Selbstauflösung des Neukantianismus dokumentiert. Im Zuge dieser Annäherung war insbesondere an Siegfried Marcks zweibändiges Werk über DIE DIALEKTIK IN DER PHILOSOPHIE DER GEGENWART (Tübingen 1929/31) anzuknüpfen, das die transzendentalphilosophische Diskussion (...) der 20er Jahre unter dem Aspekt einer „kritischen Dialektik“ zusammenfaßt; einer kritischen Dialektik, die sich aufgrund der Ablehnung der neukantianischen „Konstruktion eines idealen Subjekts“ und der darum nunmehr verstärkten Einsicht in die „Spannung zwischen dem existierenden Subjekte und dem Geltungsbereich“ ausgeformt habe und als das verbindende Motiv in „Jonas Cohns Theorie der Dialektik, R. Höngswalds Denkpsychologie, Br. Bauchs Ideenlehre, P. Natorps Lehre vom Grenzdenken, N. Hartmanns Aporetik, E. Cassirers philosophische[r] ‚Anthropologie‘, Max Adlers neukantische[m] Marxismus“ anzusehen sei (S. Marck [1929], S. III). Wie allein schon der Hinweis auf „N[icolai] Hartmanns Aporetik“ zeigt, geht diese,Hegel-Renaissance in der deutschen Philosophie‘ (H. Levy) auch Hand in Hand mit einer Ontologisierung der Transzendentalphilosophie. Dieser Transzendentalontologie, die sich - teils in dialektischem Einverständnis mit und teils in antidialektischem Gegensatz zur ‚Hegel-Renaissance‘ - mit einer nach den unterschiedlichsten Richtungen hin wirksamen ‚Leibniz-Renaissance‘ verband, war im Titel der vorliegenden Untersuchung um so mehr Rechnung zu tragen, als das ontologische Motiv (vorallem unter dem Eindruck der Hartmannschen Neo-Ontologie und der Heideggerschen Existentialontologie) in den transzendentalsystematischen Arbeiten der Nachkriegszeit eindeutig in den Vordergrund tritt. Der Titel KRITISCHE DIALEKTIK UND TRANSZENDENTALONTOLOGIE steckt daher sowohl den inhaltlichen wie auch den zeitlichen Rahmen der Untersuchung ab: ihr Thema sind die post-neukantianischen Systembildungen, die in Auseinandersetzung mit den dominierenden Philosophemen der Zwischen- und Nachkriegszeit (der Neo-Ontologie und der Lebens- und Existenzphilosophie) am transzendentalen Ansatz und Systemanspruch festhielten, indem sie den überzeitlichen Geltungsanspruch der Idee und die innerzeitliche Existenz ‚dialektisch‘ oder ‚monadologisch‘ zu vermitteln suchten. Nachdem aus transzendentalsystematischer Sicht das Ringen um eben diese Vermittlungsproblematik ohnehin die gesamte abendländische Philosophiegeschichte ‚seit Parmenides und Platon‘ beherrscht, sagt diese Eingrenzung der Thematik allerdings mehr über das Selbstverständnis der Systemdenker aus, als sie zu deren philosophiegeschichtlicher Positionierung beiträgt. Man kommt daher dem Eigentümlichen der post-neukantianischen Systembildungen näher, wenn man – ihre Differenz zum Neukantianismus hervorhebend – betont, daß sie sich aufgrund der Ablehnung der neukantianischen „Konstruktion eines idealen Subjekts“ (S. Marck) dem Problem der ‚Konkretisierung der Transzendentalität‘ (Erich Heintel) oder einer ‚Philosophie der konkreten Subjektivität‘ (Hans Wagner) stellen. Da man die Phänomenologie Husserls und die Philosophische Anthropologie in gleicher Weise charakterisieren kann, muß diese Problemstellung in unserem Zusammenhang freilich nicht so sehr als Verabschiedung, sondern als Weiterführung neukantianischer Traditionen verstanden werden; da der Versuch einer Rekonstruktion der neukantianischen Theoriestränge, die sich gegenüber den lebensphilosophischen, ontologischen und positivistischen Zersetzungen des kritizistischen Ansatzes resistent erwiesen, zur Revision einiger gängiger Vorurteile bezüglich des Neukantianismus zwingt, wird im Zuge der einleitenden Analyse der sogenannten Selbstauflösung des Neukantianismus aber auch der Begriff ‚Neukantianismus‘ selbst in grundsätzlicher Weise zu bestimmen sein. Diese Begriffsbestimmung liefert das gesuchte Kriterium für die systematische Eingrenzung der Thematik und somit für die Auswahl der Repräsentanten der Kritischen Dialektik und Transzendentalontologie, deren philosophische Bemühungen in der Folge dokumentiert sind. Durchaus in Verbindung und Übereinstimmung mit diesen systematischen Erwägungen war für die nähere Auseinandersetzung mit Richard Hönigswald und Wolfgang Cramer, Bruno Bauch und Hans Wagner, sowie mit Robert Reininger und Erich Heintel, nicht zuletzt der Umstand maßgeblich, daß ihre Arbeiten eine für die Philosophie des 20. Jahrhunderts bemerkenswerte Kontinuität transzendentalphilosophischer Ansätze demonstrieren und dennoch keineswegs die Beachtung gefunden haben, die sie im Interesse einer lebendigen Aneignung und kritischen Weiterführung der Transzendentalphilosophie verdienen. Die vorliegende Arbeit versucht vorallem diese Kontinuität transzendentalphilosophischer bzw. neukantianischer Ansätze herauszustellen und die aus der individuellen Problemsicht der genannten Autoren resultierende produktive Weiterbildung dieser Ansätze zu dokumentieren, indem sie jeweils monographisch die einzelnen Denkwege verfolgt. Social cognition differs from general cognition in its focus on understanding, perceiving, and interpreting social information. However, we argue that the significance of domain‐general processes for controlling cognition has been historically undervalued in social cognition and social neuroscience research. We suggest much of social cognition can be characterized as specialized feature representations supported by domain‐general cognitive control systems. To test this proposal, we develop a comprehensive working model, based on an interactive activation and competition architecture and applied to the control (...) of action. As such, we label the model “ICON” (interactive activation and competition model for the control of action). We used the ICON model to simulate human performance across various laboratory tasks. Our simulations emphasize that many laboratory‐based social tasks do not require socially specific control systems, such as those that are argued to rely on neural networks associated with theory‐of‐mind. Moreover, our model clarifies that perceived disruptions in social cognition, even in what appears to be disruption to the control of social cognition, can stem from deficits in social representation instead. We advocate for a “default stance” in social cognition, where control is usually general, but representation is specific. This study underscores the importance of integrating social cognition within the broader realm of domain‐general control processing, offering a unified perspective on task processing. (shrink)

Alongside other virtues like honesty, courage, integrity, and generosity, it is widely accepted that we should all strive to be humble people. But what if humility isn’t all it’s cracked up to be? Some philosophers, for example, have argued that humility can reinforce subordination and entrench exploitation. Despite some popular misconceptions, humility isn’t fundamentally about being servile. Humility doesn’t require being a doormat for whoever wants to take advantage of us. Instead, humility helps us avoid being distracted by our own (...) egos, a trait that is valuable for those from all walks of life. (shrink)

What is compassion? I suggest that it is, as Adam Smith and David Hume once argued, a moral sentiment that is subject to a great many constraints and variations but is nonetheless “natural.” I also consider Nietzsche's rather vehement attack on Mitleid and current social psychological literature on empathy.

There seems to be no end to moralizing about the vices, but there is too little appreciation of them as mere human foibles and an essential part of the “human circus.” There are also serious questions about whether some of the so-called deadly sins are sinful at all.

Too often, since the 19th century, sensitivity is dismissed as mere “sentimentality” in philosophy and in literature. It is charged that sentimentality is distorting, self-indulgent, self-deceptive. I argue that all of these charges are misplaced or themselves distorted and betray a suspicion of emotions and the tender sentiments that is unwarranted.

Do we love for reasons? Most romantics would insist not. In fact, we love despite good reasons not to love. I argue that love necessarily involves reasons. I discuss the problem of loving someone for his or her looks and what I call Plato's Problem, loving only the properties of a person. I end by discussing some dubious and perverse reasons for love.

Spirituality is often dismissed as mere sentimentality. It is also often opposed to science and the scientific worldview, as if the one is anathema to the other. I suggest that spirituality has distinct advantages over religion and is not at all opposed to science or scientific thinking.

In “Conditions and Analyses of Knowledge”, Robert Shope focuses on the conditions that must be satisfied for a person to have knowledge, specifically knowledge that something is so. Traditionally, knowledge has been analyzed in terms of justified true belief. Shope addresses philosophers’ disagreements concerning the truth and belief conditions. After introducing the justification condition, he presents challenges that have provoked several attempts to replace or to supplement the justification condition for knowledge. Shope presents and assesses several of these, including (...) early causal theories, the nonaccidentality requirement, reliable process and conditional analyses, the reliable‐indicator analysis, the conclusive reasons analysis, defeasibility analyses, analyses in terms of cognitive or intellectual virtues, and proper functionalism as well as his own account of knowledge. What does it mean to keep an “open mind”? In casual conversation it’s a popular phrase with enough common sense to negate much need for debate about what the speaker means. Someone with an open mind might be considered considerate, equanimous, empathetic, a good listener, curious, or flexible in opinion. In Western culture an open-minded person might be receptive to new ideas, possibilities, and interpretations, suggesting that they successfully maintain an engaged yet dynamic mental relationship to various subjects or challenges. Yet in science’s nascent study of consciousness, the notion of a mind “opening” is complicated by the field’s inability to clearly articulate what a mind is, let alone how, or into what, it might open. It is the purpose of this research to present the biological significance of “open-mindedness” in order to discuss possible phenomenological implications pertaining to neural correlates of consciousness (NCC). In his seminal book The Open Work, Umberto Eco describes “openness” as a phenomenon of conscious organization that “locates the infinite at the very core of the finite,” and “invites us to conceive, feel, and thus see the world as possibility.” Utilizing the methods of Mechanics, Dynamics, Aesthetics (MDA) analysis, my critical phenomenological inquiry extends Eco’s lens of cultural semiotics into quantum biology to provide key insights for understanding the aesthetic role of field dynamics in qualia physics—as interpretive events (i.e., watching a film, tasting a dessert, or drawing). In particular, pairing Eco’s semiotic analysis of openness with Hameroff and Penrose’s OR Theory concerning cognitive qualia-producing architectures such as microtubules, raises how sensations between organisms and the Zero Point Field (ZPF) are absorbed, integrated, and transmitted through quantum Stochastic Electrodynamic (SED) information states proposed by Joachim Keppler. Therefore, we can say that living systems are those systems that have adapted their material capabilities (including fundamental principles of self-organization and complexity in common cognitive architectures like awareness and attention) to perceive and critically interpret coherently. That is to say—biology has evolved to make meaning through its very aliveness. Our conscious ability to open our minds in order to interpret and communicate our sensations, thoughts, and complete experiences, therefore reveals a radically multidimensional bio-geometry and biolinguistics based on a field dynamics, which Eco’s work constructs. Via an aesthetic information theory, Eco describes this phenomenon as, “a practical level of poetics that acts as programmatic projects for creation.” The writings of Rumi, Husserl, Dewey, Emerson, Merleau-Ponty, Hegel, and others confer depth to the emergent mechanics of perception found throughout biotic systems. Eco’s ideas thereby provoke discourse on the role of openness within recent theoretical works by Jeremy England, Anirban Bandyopadhyay, Robert Lanza, Deepak Chopra, Ervin Laszlo, Giulio Tononi, Stuart Kauffman, Walter J. Freeman, Robin Carhart-Harris, Mark P. Mattson, Robert R McCrae, Selen Atasoy, Katherine Peil, Terence Deacon, and David Chalmers. Unlike models of consciousness that arise from closed, local computation, I argue that the phenomenon of open mindedness unifies cultural and scientific concepts of consciousness as life’s critical integrative force. In this book, Robert Sokolowski argues that being a person means to be involved with truth. He shows that human reason is established by syntactic composition in language, pictures, and actions and that we understand things when they are presented to us through syntax. Sokolowski highlights the role of the spoken word in human reason and examines the bodily and neurological basis for human experience. The paper offers an analysis of Protagoras’ fr. DK 80 B 1 and rejects the traditional reading of Protagoras as relativist. By considering the ipsissima verba that Protagoras makes use of in his passage, it is argued that alternative interpretations are possible, of which epistemological reism and psychological individualism are proposed. On a more general level, it is discussed to what extent Protagoras’ fragment contains descriptive rather than normative claim.
